MANILA, Philippines — The camp of Mary Ann Maslog will file a motion for reconsideration on Sandiganbayan’s decision convicting her in the graft case related to the controversial textbook scam in 1998.

Earlier Tuesday, the anti-graft court’s Second Division found Maslog guilty of one count of graft, as it likewise penalized her a maximum prison term of 10 years. She will also suffer perpetual disqualification to hold public office.

“Although we haven’t seen the decision, of course, to protect the rights of the client we will file a motion for reconsideration,” Maslog’s lawyer, Nicole Jamilla told reporters in an ambush interview after the case’s promulgation.

Asked about Maslog’s brief release from the National Bureau of Investigation (NBI) in early January, Jamilla said they had not seen a copy of the “release order” and were only informed about it days after their client returned to the facility.

But oil prices fell as markets were unimpressed with a pledge by China’s finance minister to boost the world’s second-biggest economy.

“To be candid,  Atty. [Stephen] David was in Europe at that time and it was mentioned earlier that we were not informed. And even if we were informed we would be surprised since our motion to post bail was previously denied,” she said.

“As we speak we have not seen the release order as of today so we were unaware of what happened,” she added.

In a resolution dated December 19 last year, the Second Division rejected the bail petition of Maslog for the second time.

The anti-graft court said Maslog’s motion was “bereft of merit” and pointed out that her “history of absconding, failure to voluntarily appear before the court, and use of spurious identities prove a high probability of flight.”

Besides, it added, the right to bail is “not absolute,” and granting bail based on her circumstances will “erode public confidence in the judicial system.” Maslog, along with Emilia Aranas and Ernesto Guiang of the education department (formerly known as the Department of Education, Culture and Sports), was implicated in a P24-million graft case in 1998.

In 2020, Aranas and Guiang were convicted and sentenced to a maximum prison term of 10 years by the Sandiganbayan.

Maslog’s case, on the other hand, was archived as she was reported to have died in 2019. The anti-graf court was only informed about her purported death in November 2020.
